These terms govern your use of the marketing website at ismartbiz.com (the "Site"), operated by iSmartBiz ("we", "us"), a business based in Massachusetts, USA. The iSmartBiz app at portal.ismartbiz.com, including its plans, billing, trials and cancellation, is governed by its own Terms of Service. If you use the app, those terms apply to the app. By using the Site, you agree to these terms. If you do not agree, please do not use the Site.

Using the Site

You may use the Site for lawful business and personal purposes. You agree not to:

• break or attempt to break the Site's security, or interfere with its operation;
• use automated tools to copy the Site in bulk or overload it;
• use the Site or our contact details to send spam or unlawful content; or
• present yourself as us or as affiliated with us.

Information on the Site

The Site describes our software and services, including features and pricing. We try to keep it accurate and current, but it may contain mistakes or be out of date. The features and prices that apply to you are those shown in the app when you sign up or subscribe. The Site is general information, not professional, legal, tax or financial advice.

No guarantee of results

Marketing outcomes such as search rankings, reviews, leads, bookings and revenue depend on many things we do not control, including your market, your business, competitors, and the rules and algorithms of third-party platforms like Google and social networks. Articles, guides and examples on the Site are for information only. We do not promise that you will achieve any particular result.

The Site links to services we do not own or control. We are not responsible for their content, availability, practices or policies, and linking to them is not an endorsement.

The Site's text, design, graphics, logo and code are owned by iSmartBiz or its licensors and are protected by copyright, trademark and other laws. You may view the Site and share links to it. You may not copy, modify, sell or republish its content without our written permission. The name "iSmartBiz" and our logo may not be used without permission.

If you send us suggestions or feedback, you agree we may use them without restriction or payment to you.

To the fullest extent permitted by law, the Site is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components. Some jurisdictions do not allow certain disclaimers, so part of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, iSmartBiz will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or related to your use of the Site. Our total liability for any claim relating to the Site will not exceed US$100. Nothing in these terms limits liability that cannot be limited by law.

Indemnity

You agree to be responsible for any claim, loss or expense we incur because you misuse the Site or violate these terms or the law.

Governing law and disputes

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. If a dispute arises, please email info@ismartbiz.com first so we can try to resolve it informally. If we cannot, the state and federal courts located in Massachusetts have exclusive jurisdiction, and you and we consent to that jurisdiction, except where the law of your home jurisdiction requires otherwise.

General

If any part of these terms is found unenforceable, the rest remains in effect. These terms, together with the Privacy Policy, are the entire agreement between you and us about the Site. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms without our consent.

Changes

We may update these terms. The effective date above shows the latest version, and continuing to use the Site after a change means you accept it.
